These Terms & Conditions (“Terms”) govern your access to and use of the Coco Code Marketing website, communications, and related online services.

Coco Code Marketing (“Coco Code,” “we,” “us,” or “our”) provides marketing, advertising, creative, automation, consulting, and related business services.

By accessing or using our website, submitting information through our forms, or otherwise interacting with our online services, you agree to these Terms.

If you do not agree with these Terms, please do not use the website.

1.Website Use

The information available on this website is provided for general informational and commercial purposes regarding Coco Code Marketing and its services.

You agree to use the website only for lawful purposes and not to:

  • Interfere with the operation or security of the website.
  • Attempt to gain unauthorized access to systems, accounts, or information.
  • Submit false, misleading, fraudulent, or unlawful information.
  • Use automated systems to scrape, copy, overload, or interfere with the website without authorization.
  • Use the website in a manner that violates applicable laws or the rights of others.

We may restrict or terminate access to the website where reasonably necessary to protect our systems, business, users, or legal rights.

2.Eligibility

You must be at least 18 years old to enter into a paid service agreement with Coco Code Marketing or otherwise have the legal authority to enter into an agreement on behalf of a business or organization.

By purchasing services or entering into an agreement with us, you represent that you have the legal capacity and authority to do so.

3.Service Inquiries and Requests

Submitting a contact form, lead form, chat message, request for information, application, or other inquiry does not create a client relationship or binding service agreement.

Any specific scope of work, deliverables, fees, timelines, payment terms, cancellation terms, refund policies, intellectual property arrangements, or other project-specific conditions will be established separately through an applicable proposal, service agreement, invoice, order form, statement of work, or other written agreement.

If there is a conflict between these website Terms and a separately executed client agreement, the client agreement will control with respect to the applicable services.

4.Estimates, Pricing and Availability

Any pricing, offers, promotional terms, examples, packages, or service descriptions displayed on our website or advertisements may be subject to:

  • Availability.
  • Eligibility.
  • Project scope.
  • Geographic restrictions.
  • Promotional periods.
  • Capacity limitations.
  • Additional terms communicated before purchase.

Unless expressly stated otherwise in a binding agreement, information displayed on the website does not constitute a guaranteed quote or contractual offer.

We may modify or discontinue website offers and service packages at any time, subject to any existing contractual obligations.

5.Payments and Client Services

Payment terms for paid services will be communicated before purchase or included in the applicable proposal, invoice, checkout, or client agreement.

Any recurring fees, cancellation rights, refunds, payment schedules, deposits, or other financial conditions will be governed by the terms presented for the applicable service.

These website Terms do not create a separate refund or cancellation right where one has not otherwise been agreed to or required by applicable law.

6.Results and Marketing Performance

Marketing, advertising, lead generation, social media, creative, automation, website, consulting, and similar services involve factors that may be outside Coco Code Marketing’s control.

Unless expressly guaranteed in a separate written agreement, we do not guarantee:

  • A specific number of leads.
  • A specific cost per lead or acquisition.
  • Sales or revenue levels.
  • Advertising performance.
  • Search rankings.
  • Social media reach or engagement.
  • Conversion rates.
  • Business growth.
  • Platform approvals.
  • Continued availability of third-party platforms or advertising accounts.

Past results, examples, testimonials, case studies, projections, or estimates do not guarantee future results.

7.Third-Party Platforms and Services

Our services and website may interact with or link to third-party platforms, including advertising platforms, social networks, CRM systems, payment processors, analytics providers, scheduling platforms, communication services, hosting providers, and other software.

Examples may include platforms operated by Meta, Google, HighLevel, and other providers.

We do not control third-party services and are not responsible for:

  • Changes to their features, pricing, policies, algorithms, or availability.
  • Suspensions or restrictions imposed by those providers.
  • Third-party outages.
  • Their independent privacy or security practices.
  • Actions taken directly by a third-party platform.

Your use of third-party services may also be governed by that provider’s own terms and policies.

8.Email Communications

When you provide your email address in connection with an inquiry, service, account, application, or other request, we may use email to respond to you and communicate about that request.

Where we send promotional or commercial email communications, we will do so in accordance with applicable consent and marketing requirements.

Providing an email address does not automatically constitute consent to receive every category of marketing communication. Where express marketing consent is required, it will be requested separately or another lawful basis must apply.

Marketing emails will include an appropriate method for unsubscribing where required.

Unsubscribing from marketing communications does not necessarily prevent us from sending messages that are necessary to respond to your request, perform contracted services, administer an account, address a transaction, or comply with applicable law.

For commercial electronic messages sent to recipients in Canada, CASL generally requires consent, identification information, and a functioning unsubscribe mechanism.

9.SMS and Text Messaging Terms

Coco Code Marketing may offer SMS/text messaging for certain communications.

Depending on the consent you provide, messages may include:

  • Responses to inquiries.
  • Customer support communications.
  • Appointment or scheduling information.
  • Service updates.
  • Follow-ups relating to a request you submitted.
  • Account or onboarding communications.
  • Promotional offers or marketing messages where you have agreed to receive them.

Consent

SMS consent must be provided through the applicable opt-in process.

Consent to receive marketing text messages is optional and is not a condition of purchasing any goods or services.

Where Coco Code Marketing offers both marketing and non-marketing SMS communications, consent may be requested separately for those categories.

HighLevel's toll-free messaging requirements currently require affirmative, optional consent and separate choices where both marketing and non-marketing messaging are offered.

Message Frequency

Message frequency may vary depending on your interaction with Coco Code Marketing and the type of messages you agreed to receive.

Message and Data Rates

Message and data rates may apply.

Charges, if any, are determined by your mobile carrier and mobile service plan.

Opt-Out

You may opt out of applicable SMS communications at any time by replying:

STOP

After a valid opt-out, we will stop sending the applicable messages unless you subsequently provide valid consent to receive them again.

Help

For assistance regarding SMS communications, reply:

HELP

or contact us using the information listed in the Contact section below.

Carrier Availability

Delivery of SMS messages is subject to mobile carrier networks and services. Coco Code Marketing is not responsible for delayed or undelivered messages caused by circumstances outside our reasonable control.

Privacy

Information collected through our SMS program is handled according to our Privacy Policy:

https://cococode.ai/privacy-policy

Mobile numbers and SMS consent information are not sold or shared with third parties for their own marketing or promotional purposes as described in our Privacy Policy.

The carrier verification process expects the sender identity, message types, message frequency, potential carrier charges, HELP/STOP instructions, Privacy Policy and Terms to align with the actual consent workflow.

10.Canadian Electronic Communications

If a commercial electronic message is sent to a recipient in Canada, applicable Canadian anti-spam requirements may apply even if Coco Code Marketing or its technology providers are located outside Canada.

For applicable commercial electronic messages, Coco Code Marketing will use consent or another legally permitted basis, provide required sender identification, and make an unsubscribe mechanism available.

Canadian rules expressly apply to commercial emails and SMS messages sent to electronic addresses in Canada, including messages originating outside Canada.

Where applicable, unsubscribe requests will be processed within the period required by law. Canadian guidance currently requires qualifying unsubscribe requests to be acted upon within 10 business days.

11.Communications Consent Is Channel-Specific

Consent to one type of communication does not necessarily mean you consent to all communication channels or purposes.

For example:

  • Providing a phone number for a requested call does not automatically mean you consent to marketing SMS.
  • Providing an email address to receive a requested response does not automatically mean you consent to ongoing promotional emails.
  • Agreeing to service or transactional SMS does not automatically mean you agree to marketing SMS.

Where separate consent is required, Coco Code Marketing will provide separate opt-in choices.

12.Intellectual Property

Unless otherwise indicated, the content available on this website—including branding, text, graphics, designs, videos, images, layouts, concepts, website elements, and other materials—is owned by or licensed to Coco Code Marketing and is protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, publish, commercially exploit, or create derivative works from website content without prior written authorization, except where permitted by law.

Coco Code Marketing, Coco Code, associated branding, and related marks may not be used in a manner that implies endorsement, partnership, or affiliation without authorization.

13.Materials You Provide

If you voluntarily provide information, files, logos, photographs, videos, advertising materials, business information, or other content to us in connection with an inquiry or service, you represent that you have the necessary rights and authorization to provide that material.

Project-specific rights relating to client content, deliverables, licenses, ownership, and portfolio use may be governed by a separate client agreement.

14.Feedback

If you voluntarily provide suggestions, comments, or general feedback regarding our website or services, we may use that feedback to improve our business and services.

Nothing in this provision transfers ownership of confidential client materials or intellectual property governed by a separate agreement.

15.Privacy

Your use of our website and services is also subject to our Privacy Policy.

Please review it here:

https://cococode.ai/privacy-policy

The Privacy Policy explains how we collect, use, disclose, retain, and protect personal information, including information associated with email and SMS communications.

16.External Links

The website may contain links to third-party websites or services.

These links are provided for convenience or informational purposes. Unless expressly stated otherwise, a link does not constitute endorsement or control of the third-party service.

We are not responsible for the content, availability, security, privacy practices, or terms of third-party websites.

17.Website Availability

We attempt to maintain reasonable availability and accuracy of our website, but we do not guarantee that:

  • The website will always be available.
  • Access will be uninterrupted or error-free.
  • All information will always be current.
  • The website will be free from technical issues or third-party outages.

We may update, suspend, modify, or discontinue portions of the website at any time.

18.Disclaimer of Warranties

To the maximum extent permitted by applicable law, the website and its general informational content are provided on an “as is” and “as available” basis.

Except for obligations expressly provided in a separate written agreement or required by law, Coco Code Marketing makes no representation or warranty regarding the website’s uninterrupted availability, accuracy, completeness, or suitability for a particular purpose.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

19.Limitation of Liability

To the maximum extent permitted by applicable law, Coco Code Marketing will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from use of or inability to use the website.

Any liability relating to paid client services may be governed separately by the applicable service agreement.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

20.Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses, claims, or liabilities resulting from your unlawful use of the website, violation of these Terms, or infringement of another party’s rights.

This section does not expand any indemnification obligation contained in a separate client agreement.

21.Changes to These Terms

We may update these Terms from time to time to reflect changes in our website, services, communications practices, technology, or legal requirements.

The updated Terms will be posted on this page with a revised Last Updated date.

Your continued use of the website after an update constitutes acceptance of the revised Terms to the extent permitted by applicable law.
